These Terms and Conditions govern the use of the Wellamo Living website and the purchase of services provided by Wellamo Living / Wellamo Agency.

By using this website or requesting, booking or purchasing our services, you acknowledge that you have read and understood these Terms and Conditions. Service-specific terms, pricing and details may also be set out separately in a service proposal, written confirmation, invoice or other agreement between Wellamo Living and the client.

1. About Wellamo Living

Wellamo Living / Wellamo Agency is a Finland-based independent relocation consultancy and lifestyle service provider.

Wellamo Living provides independent relocation consulting and related support services, with a particular focus on Spain, property search support, holiday homes, local coordination and interior design.

Wellamo Living is not a real estate agent or broker and does not act as the seller, property owner, developer, lawyer, tax adviser, financial adviser, architect, surveyor, contractor or other regulated professional unless expressly agreed otherwise in writing and legally permitted.

2. Services

​

Depending on the service agreed with the client, Wellamo Living may provide services including:

• relocation consulting and guidance;

• support with exploring and planning a move to Spain;

• property and holiday home research and search support;

• preparing property shortlists based on information and preferences provided by the client;

• communication and coordination support with relevant parties;

• local recommendations and practical relocation guidance;

• assistance with coordinating independent third-party service providers;

• interior design and related design services;

• online consultations;

• other services specifically agreed in writing.

The exact scope, deliverables, price and timetable of a service are determined by the applicable service proposal, written confirmation, invoice or separate agreement.

Wellamo Living is not required to provide services that have not been expressly agreed.

3. Enquiries, proposals and formation of a contract

​

A general enquiry, contact form submission or request for information does not create a binding contract.

A binding agreement is formed only when the service has been clearly confirmed in writing by Wellamo Living and the applicable service terms, price and scope have been accepted by the client.

A service proposal, written confirmation or invoice may contain additional terms that apply specifically to the service concerned. If there is a conflict between these Terms and Conditions and a specific written service agreement, the specific service agreement will apply to the extent of the conflict.

Wellamo Living reserves the right to decline a request for services before a binding agreement has been formed.

4. Client responsibilities

​

The client is responsible for providing accurate, complete and up-to-date information that is reasonably necessary for the provision of the agreed services.

The client is responsible for making their own final decisions regarding properties, purchases, relocation, contracts and other commitments.

The client must independently verify information that is material to their decisions and obtain professional advice where appropriate.

Depending on the matter, this may include independent legal, tax, financial, mortgage, technical, architectural, building or other professional advice.

Wellamo Living may provide guidance, research, coordination and practical support, but does not replace independent professional advice.

5. Property and relocation services

​

Property-related information may be obtained from third parties, including property owners, sellers, estate agencies, developers, public sources and other service providers.

Wellamo Living may assist the client in researching, identifying, comparing or coordinating property-related opportunities. However, Wellamo Living does not guarantee the accuracy, completeness, legality, condition, value, availability, suitability or future performance of any property.

Unless expressly agreed otherwise in writing, Wellamo Living does not:

• act as a real estate agent or broker;

• represent the seller or property owner;

• guarantee that a property is a good investment;

• guarantee that a property is legally, technically or financially suitable;

• conduct legal, tax, structural or technical due diligence;

• guarantee that a property transaction will be completed;

• guarantee the approval of a mortgage, visa, residence permit or other application;

• make decisions on behalf of the client.

The client is responsible for obtaining independent professional advice before making a purchase or other legally binding commitment.

6. Independent third-party service providers

​

Wellamo Living may introduce, recommend or help coordinate independent third-party service providers, such as estate agencies, lawyers, tax advisers, architects, surveyors, contractors, moving companies or other professionals.

Unless expressly agreed otherwise in writing, these providers act independently and under their own terms and conditions.

Any agreement for a third-party service is entered into directly between the client and the relevant third-party provider, unless expressly agreed otherwise in writing.

Third-party providers are responsible for their own services, advice, work, pricing, availability, contractual obligations and legal compliance.

Wellamo Living does not guarantee the performance, availability, pricing or outcome of services provided by independent third parties.

Wellamo Living will take reasonable care when recommending or coordinating third-party providers. However, Wellamo Living is not responsible for the acts, omissions, advice, work or contractual obligations of an independent third-party provider, except to the extent that applicable law provides otherwise.

7. Interior design services

​

The scope of each interior design project will be agreed separately.

Depending on the agreed service, interior design services may include concepts, moodboards, layouts, material suggestions, colour schemes, furniture recommendations, visualisations, sourcing support or other design-related work.

Unless expressly agreed otherwise, design services do not include construction, structural engineering, architectural services, building permits, technical inspections, project management or contractor services.

The client is responsible for approving designs, measurements, specifications, materials and other project decisions before implementation.

The client is responsible for ensuring that any proposed implementation complies with applicable laws, regulations, building requirements and technical requirements.

8. Online consultations

​

Online consultations are provided based on the information available to Wellamo Living at the time of the consultation.

Advice provided during an online consultation is general guidance and does not constitute legal, tax, financial, medical, architectural, structural or other regulated professional advice unless expressly stated otherwise.

The client is responsible for providing accurate information and making their own decisions based on the consultation.

9. Fees and payment

​

The price of each service will be communicated to the client before the service is confirmed.

Services are generally booked through a written booking request or other agreed confirmation process and invoiced separately.

Unless otherwise agreed in writing, the invoice must be paid by the due date stated on the invoice.

Wellamo Living may suspend or delay the provision of services if an invoice is overdue.

Any additional work requested by the client that falls outside the agreed scope may be charged separately, subject to prior agreement where reasonably possible.

10. Changes and cancellations

​

The applicable cancellation and rescheduling terms may be specified in the relevant service proposal, confirmation or invoice.

If no specific terms have been agreed, the client should contact Wellamo Living as soon as possible if they wish to cancel or reschedule a service.

Wellamo Living will consider reasonable requests for changes or rescheduling where possible.

The client's statutory consumer rights, including any applicable statutory right of withdrawal, remain unaffected.

For distance contracts involving consumers, statutory withdrawal rights may apply. Where a client expressly requests that a service begins during the withdrawal period, the client may be required to pay a proportionate amount for services already performed, as provided by applicable law.

Where a service is fully performed during the withdrawal period, the right of withdrawal may end where the legal requirements for this exception are met, including the client's express request and legally required acknowledgement.

Nothing in these Terms and Conditions limits rights that cannot legally be excluded.

11. Delays and events outside our control

​

Wellamo Living will make reasonable efforts to provide services as agreed.

Wellamo Living is not responsible for delays or failures caused by circumstances reasonably beyond its control, including delays or actions by third parties, changes in law or regulations, governmental decisions, strikes, technical failures, natural disasters, travel disruptions or other force majeure circumstances.

Where reasonably possible, Wellamo Living will inform the client of material delays and discuss appropriate next steps.

12. Intellectual property

​

Unless otherwise agreed in writing, all original concepts, designs, drawings, moodboards, written materials, presentations, visualisations, text, photographs, branding materials and other materials created by Wellamo Living remain protected by applicable intellectual property rights.

After full payment of the agreed fees, the client receives a limited, non-exclusive right to use the final materials for the agreed project and personal purposes.

The client may not reproduce, sell, distribute, commercially exploit or substantially modify materials created by Wellamo Living without prior written permission, unless otherwise agreed in writing.

Wellamo Living may display completed work in its portfolio, website and marketing materials only where this is permitted by the applicable agreement and privacy requirements.

13. Website content

The content on this website is provided for general informational and inspirational purposes.

We aim to keep information accurate and up to date, but we do not guarantee that all website content is complete, current or free from errors.

Website content does not constitute legal, tax, financial, investment, architectural, technical or other professional advice.

14. Limitation of liability

​

Wellamo Living is responsible for providing the services agreed with the client with reasonable care and skill as required by applicable law.

Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, Wellamo Living is not responsible for:

• decisions made by the client based on general guidance or information;

• the acts, omissions or services of independent third-party providers;

• inaccurate information supplied by third parties;

• changes in property availability, pricing or market conditions;

• decisions made by property owners, sellers, estate agencies, developers, authorities or other third parties;

• indirect losses that are not reasonably foreseeable at the time the contract was formed.

This section does not limit any mandatory rights or remedies available to consumers under applicable law.

15. Privacy

​

Personal data is processed in accordance with the Wellamo Living Privacy Policy.

16. Changes to these Terms and Conditions

​

We may update these Terms and Conditions from time to time to reflect changes in our services, website or legal requirements.

The version applicable to a service agreement is the version in effect when the relevant agreement is formed, unless a later change is required by law or otherwise agreed with the client.

17. Governing law and disputes

​

These Terms and Conditions are governed by Finnish law, unless mandatory provisions of consumer protection law applicable to the client provide otherwise.

Nothing in these Terms and Conditions limits a consumer's mandatory legal rights or right to bring a dispute before a competent court or other dispute resolution body available under applicable law.

Where appropriate, the parties will first try to resolve any dispute through direct communication.
